Two House bills considered hauling. As introduced, HB05-1011 exempts haulers from an existing covered load requirement when transported material is not likely to escape from the vehicle (i.e., scrap metal) and HB05-1126 requires tire haulers to be licensed by CDPHE and designate destinations. Both bills were passed into law. A third bill (HB05-1256) included comprehensive recycling components such as voluntary state diversion goals, development of recycling market development zones, management of cathode ray tubes, and a landfill tip fee surcharge (ranging from $0.25 to $1.25/ton). This bill underwent significant changes in the House and was ultimately defeated in the Senate. One Senate bill (SM05-141) addressed disposal restrictions on whole passenger tires, lead-acid batteries and used motor oil (< 1 quart). These restrictions primarily apply to residential generators and have minimal impact on haulers (required only to notify customers) and landfills (generally indemnified if a management plan is in place) who may pursue one of several tire management options. Effective in 2007, residents can be fined up to $100 per violation. This bill has become Colorado law.
